Who Needs a Will?

Everyone. If you have a spouse or children, own a home or property, or own any assets that you want passed on to someone specific, you need a will.

A will allows you to:

  • Designate who will receive your money, assets, property, etc.
  • Name a guardian for a minor child, disabled adult child, or disabled spouse
  • Avoid having the state decide who gets your possessions
  • Avoid having the state appoint a guardian for your loved ones
  • Lessen the chance of costly probate actions or will contests
  • Have peace of mind knowing that your loved ones will be cared for

Do I Need an Attorney to a Make a Will?

Not necessarily. However if your situation is complicated — if you have a previous marriage, blended family, a disabled child or spouse, or have high value assets — it is recommended that you consult an attorney.
An attorney will also help you to avoid costly probate actions or will contests. Individual estates are administered by the courts through a process called probate. Even if you have a last will and testament, your estate will go through probate. At Ascione Law, we can help you minimize this risk.
